General sales and rental conditions
1. Purpose
These General Terms and Conditions of Sale and Rental govern the rental of equipment and household linen offered by LA STELLA MEGEVE SASU, including, but not limited to: bed and bath linen, cots, childcare equipment, household appliances, and other accessories intended for domestic use.
These General Terms and Conditions of Sale (GTCS) apply to all orders placed on the La Stella website or by any other means made available by the company.
All orders imply the customer's unreserved acceptance of these General Terms and Conditions of Sale.

3. Definitions
Any individual or legal entity placing an order with LA STELLA MEGEVE SASU. All equipment made available for rental, such as household linen, childcare equipment, and small household appliances. Agreement between LA STELLA MEGEVE SASU and the customer defining the rental terms and conditions.
4. Pre-contractual information
4.1 The CUSTOMER acknowledges that, prior to placing an order and entering into a contract, he/she has been provided, in a legible and comprehensible manner, with the present general terms and conditions and all the information listed in article L.221-5 of the French Consumer Code.
4.2 The following information is provided to the CLIENT in a clear and comprehensible manner:
- the essential features of the service,
- the price of the service,
- all additional costs of transport, delivery or postage and any other costs, in particular the amount of penalties for delay in returning the products,
- information on the identity of the service provider, its postal, telephone and electronic contact details, and its activities, as well as information on legal guarantees, the functionalities of digital content and, where applicable, its interoperability, the existence and implementation of guarantees and other contractual conditions,
- terms of payment, delivery and performance of the contract, as well as the professional's complaint handling procedures,
- the existence of and procedures for exercising the legal guarantee of conformity provided for in articles L.217-1 et seq. of the French Consumer Code, as well as the commercial guarantee and after-sales service, referred to respectively in articles L.217-15 and L.217-17 of the French Consumer Code,
- the duration of the contract.
For any question relating to the follow-up of an order, the CUSTOMER must contact the platform in charge of his order at the address and specific number shown on the order form, although a general email address exists (contact@lastella-megeve.com).
5. Site Access and Ordering
Access to the site is free, lastella-megeve.com. Orders can be placed online or by any other communication channel accepted by LA STELLA MEGEVE SASU. The online catalog presents the equipment available for rental. The order is validated after selection of the equipment and acceptance of these GCS. An order confirmation is sent to the customer's e-mail address. In the event that the service cannot be provided, notably in the event of an error in order processing or product availability by the platform, the CLIENT will be informed by e-mail. The order for this service will then be cancelled and reimbursed if necessary, with the remainder of the order remaining firm and definitive.
6. Contract formation and performance
The contract is formed when the order is validated. The reservation is valid for the agreed duration. Any changes or cancellations must be notified in good time.
The online provision of the CLIENT's bank card and the final validation of the order will constitute proof of the CLIENT's agreement to the order:
- payment of the sums due under the purchase order ;
- signature and express exception of all operations carried out.
In the event of fraudulent use of a credit card, the CLIENT is invited to contact LA STELLA MEGEVE SASU at the following address, providing as much information as possible: contact@lastella-megeve.com.
7. Product information
The services governed by these terms and conditions are those which appear on the LA STELLA MEGEVE SASU website and which are indicated as being provided by LA STELLA MEGEVE SASU or under its control. They are offered within the limits of the service provider's availability. Services are described and presented as accurately as possible. However, the service provider cannot be held responsible for any errors or omissions. The products governed by these terms and conditions are those which appear on the Provider's website and which are indicated as being for hire by the Provider. They are offered while stocks last. LA STELLA MEGEVE SASU reserves the right to offer equivalent products. The products are described and presented as accurately as possible. None of the photographs or descriptions presented on the website by LA STELLA MEGEVE SASU have any contractual value and do not bind LA STELLA MEGEVE SASU with respect to CLIENTS.
8. Rates and payment terms
LA STELLA MEGEVE SASU reserves the right to modify its prices at any time, but undertakes to apply the current prices indicated at the time of the order, subject to availability on that date. Prices are those indicated on the LA STELLA MEGEVE SASU website, in consideration of the information provided by the CLIENT (date, geographical area). Prices are indicated in euros. Prices take into account the VAT applicable on the day of the order, and any change in the applicable VAT rate will be automatically reflected in the price of the products in the online store. Payment in full must be made at the time of ordering. At no time may the sums paid be considered as deposits or advance payments. Should one or more taxes or contributions, notably environmental, be created or modified, either upwards or downwards, this change may be reflected in the sale price of the products. The price is payable in full, in a single instalment, immediately upon ordering.
9. Delivery and return of equipment
Delivery means the transfer to the CLIENT of physical possession or control of the goods. Delivery is only made once payment has been confirmed by the service provider's bank. Products ordered are delivered in different ways:
- when ordering, the CLIENT chooses to have the order delivered to his/her home or to any other location of his/her choice.
- the CLIENT may, at his/her request, have an invoice sent to the billing address and not to the delivery address, by validating the option provided for this purpose on the order form.
- If the CLIENT has chosen to have the order delivered, the delivery will be made to the address indicated by the CLIENT on the order form. The CLIENT must ensure that this address is correct. If the CLIENT is absent on the day of delivery, the deliveryman will leave a delivery notice in the letterbox, allowing the CLIENT to collect the parcel at the place and within the time indicated.
In the event of difficulties, or changes, in the conditions or deadlines for returning linen and/or equipment, the CLIENT undertakes to inform the company. In the event of late return, or in the event of return of linen or equipment damaged in any way whatsoever, the customer will be invoiced the replacement cost per item.
10. Tenant's obligations and responsibilities
The CLIENT undertakes to use the rented equipment in accordance with its usual purpose and not to do anything or allow anything to be done that could damage it. For the entire duration of the rental period, the CLIENT is obliged to maintain the rented equipment and to protect it against any damage, vandalism, bad weather, rain, wind, snow, frost, etc. Similarly, the CLIENT must take all possible care to ensure that the rented linen is used and kept in good condition. The CLIENT formally refrains from using another company, under any pretext whatsoever, to maintain linen or equipment belonging to LA STELLA MEGEVE SASU. Any breach of this undertaking will expose the CLIENT to immediate payment of the full value of the items provided by the company.
LA STELLA MEGEVE SASU at its disposal. As a consequence of the above, the CUSTOMER undertakes to indemnify LA STELLA MEGEVE SASU for any damage caused to the textile and equipment by misuse, inappropriate use, negligence, or more generally non-compliance with the above recommendations.
STELLA MEGEVE SASU from any claim made against it as a result, according to the assessment that will be retained by the provider.
11. Insurance and Liability of the Company.
LA STELLA MEGEVE SASU guarantees the CUSTOMER against any lack of conformity of the services and any latent defect resulting from a defect in the design or supply of said services, to the exclusion of any negligence or fault on the part of the CUSTOMER. In any event, should LA STELLA MEGEVE SASU be held liable, its warranty will be limited to the amount paid by the CLIENT for the provision of the services, exclusive of VAT.
All circumstances beyond the control of the parties, preventing the performance of their obligations under normal conditions, are considered as grounds for exoneration from the obligations of the parties and lead to their suspension. The party invoking the aforementioned circumstances must immediately notify the other party of their occurrence, as well as of their disappearance.
12. Right of Withdrawal and Cancellation
Article 22 - Withdrawal The French Consumer Code gives consumers and businesses (under the conditions of article L121-16-1 III) the right to withdraw from the contract for a period of 14 days from the conclusion of the contract (provision of services. Provided that the rental service, linen delivery and/or equipment have not been performed within this period, or from receipt of the goods. This right of withdrawal may be exercised by sending a simple letter to the following address: contact@lastella-megeve.com, stating unequivocally that the CLIENT intends to exercise this right. If this right of withdrawal is exercised within the aforementioned period, the price of the service purchased will be reimbursed. The cost of returning the goods will be borne by the service provider. Reimbursement will be made within 14 days of receipt by the service provider of the products returned by the CLIENT in accordance with the above conditions. If the right of withdrawal is exercised within the aforementioned period, the price of the service purchased will be reimbursed. Return shipping costs are the responsibility of the service provider. Reimbursement will be made within 14 days of receipt by the service provider of the products returned by the CLIENT under the conditions set out below.
13. Protection of Personal Data
The CUSTOMER is informed that his or her personal data may be collected on the Site and used by LA STELLA MEGEVE SASU, which acts as data controller within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the physical protection with regard to the processing of personal data and on the free movement of such data. The data collected is the surname, first name, e-mail address, postal address, telephone number (not obligatory) and date of birth (not obligatory) at the time of opening the account for delivery, and bank details at the time of payment.
STELLA MEGEVE SASU undertakes to protect and ensure the security and confidentiality of its CUSTOMERS' personal data in accordance with the RGPD, in particular by taking all necessary precautions to prevent such data from being distorted, damaged or accessed by unauthorized third parties. In particular, CLIENTS' personal data may be transmitted to service providers and contractual partners who, as subcontractors within the meaning of the RGPD, intervene and contribute directly to the management of Orders. For whom it is absolutely necessary to access the personal data entered by the CLIENT when creating and using his/her ACCOUNT (identity, postal address, telephone number, e-mail address). Subcontractors may only act on the instructions of LA STELLA MEGEVE SASU.
CLIENTS' personal data is collected for the following purposes:
- managing orders and relations with CUSTOMERS;
- informing CLIENTS about offers and commercial information relating to the brand;
- improving the services offered to CLIENTS;
- compliance with legal and regulatory obligations.
The CLIENT's personal data is kept only for as long as is strictly necessary for the above-mentioned purposes.
In accordance with the RGPD, the CLIENT has a right of access, rectification and opposition to personal data concerning him.

14. Intellectual Property
The content of the website (technical documents, drawings, photographs, etc.) remains the property of the service provider, who is the sole owner of the intellectual property rights to this content. Hirers undertake not to make any use of this content; any total or partial reproduction of this content is strictly forbidden and may constitute an infringement of copyright.
15. Dispute Resolution
These general terms and conditions are governed by French law, to the exclusion of the provisions of the Vienna Convention. This applies to both substantive and formal rules. In the event of any dispute or claim, the CLIENT shall first contact the service provider to obtain an amicable solution. If they are unable to do so, the parties shall submit the dispute to the courts of the jurisdiction of the service provider's registered office.
16. Miscellaneous provisions
The present general terms and conditions are available on the lastella-megeve.com internal website and will prevail, if necessary, over any other version or any other contradictory document. LA STELLA MEGEVE SASU and the CUSTOMER agree that the present terms and conditions exclusively govern their relationship. LA STELLA MEGEVE SASU reserves the right to modify these terms and conditions from time to time.
